National Defense Authorization Act Passes; Purchasing Regulations Implemented

This past week legislation successfully passed the National Defense Authorization Act, which puts authorized suppliers such as Rochester Electronics at the forefront of purchasing protocol, and will help protect the integrity of the semiconductor supply chain going forward. The passing of this act means that unauthorized sources and gray-market suppliers will not be looked to as the initial source for obtaining hard-to-find devices.

Section C3A best outlines the newly implemented regulations.

Under the “Section C: Regulations” legislation strictly states the following-

(3) TRUSTED SUPPLIERS.—The revised regulations issued pursuant to paragraph (1) shall—

(A) require that, whenever possible, the Department and Department contractors and subcontractors at all tiers—

(i) obtain electronic parts that are in production or currently available in stock from the original manufacturers of the parts or their authorized dealers, or from trusted suppliers who obtain such parts exclusively from the original manufacturers of the parts or their authorized dealers; and

(ii) obtain electronic parts that are not in production or currently available in stock from trusted suppliers;
